Domains, domain law and trademark law

Domain law, in particular the question as to who has the rights to a domain or whether the publication of a domain by a third party can be demanded is a special subject within trademark and naming law. It is easy to take action in Germany in the area of the .de domain and against proprietors resident in Germany.

In the case of .com, .org or .net domains whose proprietors are not resident in Germany, it is not easily possible to take action in Germany. In cases of obvious domain grabbing an arbitration proceedings can be brought before the WIPO in Geneva.
